I challenge Professor Wijesinha or any official in the Government of Sri Lanka to debate me over the model genocide indictment: Bruce Fein :

Bruce Fein is only the representative of Tamils Against Genocide, Maryland, USA and not the Attorney of "ANY" record, in Washington or Maryland, USA.

Debating K T Rajasingam, (Asian Tribune), Brahmin Subramaniam Swamy of India, Bernard Goonetileke, Jaliya Wickremasinghe the Ambassadors for Sri Lanka in Washington, or this Non Entity of a Sinhala Buddhist, some professor in Colombo Rajiva Wijayasinghe for debate on the "model Indictment" (Gothabaya rajapakse and General Sarath Fonseka) to the new Attorney General and Secretary of State next year, are all exercise in seeking cheap publicity. This does not make an iota of difference to the Department of Justice, where Bruce Fein worked for a short period in 1981, 27 years ago, or in the Federal Courts, if Tamils ever file a single document using this attorney. This is all playing "mind games" and taking "cheap shots" at the Singhala and Tamil gallery, and only to further enhance the $1,000 dollars a day legal fees. The new Attorney General select Eric Holder, nor Secretary of Stae senator Hilary Clinton would not have the time nor patience for such "games".

Tamils For Justice who revived and helped this attorney as a paid Op Ed columnist for the Washington Times, from his personal and financial challenges knows better about MONEY, and desperate need of people who want MONEY.

2008 has been the best year ever, like the "grapes growers" would say, and this attorney would also "sheepishly admit", of the revenues from Tamils For Justice, Justice For Thamils, Toronto, Canada, (TEAG Toronto which gave $5,600 sent to Mattie fein in June), Tamils Against Genocide, and other Tamil mavericks. Tamils Refugee Organization -The TRO which is now proscribed in the USA with million dollars of Tamil funds frozen for over a year operates in 50 States with many agents, fund collectors and fund raisers. Sreetharan is head and controller in chief of both the organizations and many more.

Bruce Fein is Right when he states in response to Wijayasingha, Quote "

Yes, his client M Sreethran is a first year law student now, and is studying the
"Genocide in Yugoslavia" as his favorite subject, he admitted to the Tamils For Justice when he first approached Tamils for Justice and it's attorney Bruce Fein
in June this year, under false and fraudulent circumstances.

Then he showed the "MONEY" from other Tamil Charities to Bruce Fein that was available in abundance, given the fact that Tamil Charities under his control
were proscribed in the USA.
The rest was "history".

In this "Model Indictment" the law is on Genocide. All aspects of Genocide in
the Island of Sri Lanka, and the perpetrators of the Genocide in 2007 and 2008.
Bruce Fein has to prove beyond reasonable doubt to the Federal Courts and the
Department of Justice that there is GENOCIDE in Sri Lanka, and the perpetrators
are an US Citizen and resident.

The first place to start would be Human Rights Watch, UN Agencies which operated in the areas of conflict during this period, recognized media and Amnesty International, to obtain their concurrence and support that there is indeed GENOCIDE that has occurred in 2007 and 2008. Not that King Duttu Gemunu committed GENOCIDE or President J R Jayawardene committed GENOCIDE in 1983, or the other Presidents like Premadasa, Wijetunge and Chandrika Bandaranayake Kumaratunghe committed GENOCIDE.
Of all these individuals only President Chandrika is alive, who happens to be a
very good friend of the new Secretary of State Senator Hilary Clinton and her
husband former President Bill Clinton.

When President Clinton releases the names of foreigners who donated funds to the
GCI one prominent Sinhalese who is closely connected to President Chandrika would also emerge.

So without looking for cheap publicity in attempting to debate in the dark halls of non entities or useless diplomats, journalist and politicians, Fein needs to start with providing credible GENOCIDE evidence, affidavits, eye witness reports and accounts of victims/survivors, that were provided and arranged previously by Tamils For Justice, to the Federal Courts or US Attorneys as originally planned, initiated, and arranged for human rights violations. Fein needs to first talk to an US Attorney like Patrick Fitzgerald in Washington, New York, Los Angeles or Oklohoma. Debating an old Singhalese Professor in Colombo does not prove anything on Genocide. One has to convince the US Attorney at the Department of Justice and the Grand Jury that Genocide has occurred in Sri Lanka, and the perpetrators are US Citizens/Residents should be the focal point to focus on. This professor is not even an attorney, diplomat, nor civil servant, but a Rajapakse political appointee, stooge, and cheer leader.

"400 + pages of Model Indictments" to the department of Justice next year is an exercise in futility and misleading the Tamils, that litigation and investigations is imminent in the United States of America. One should read the Tamil newspaper stories in Sri Lanka, Canada and Europe who have even mistakenly believed that the indictment has occurred or imminent in January.

Fein has already wasted colossal amount of Tamil money and time for over a year. Realistic and pragmatic objectives need to be attempted, which could have been easily
accomplished if not for the interference of the Tamils Against Genocide and
Justice For Thamils, Toronto, Canada, and a few others. What has been accomplished in the past 6 months is only enriched one individual, and squandered Tamil Money.

Here is the response, which will generate more responses from the racist-chauvinist
Singhalese, in the lunatic fringe. This keeps the verbal debate alive, exciting everyone, without accomplishing any thing substantive.

Responding to the note on Secretariat for Coordinating the Peace Process (SCOPP) website by the Secretary General Prof. Rajiva Wijesinha on the model genocide indictment against Sri Lanka officials, the former U.S. Deputy Associate Attorney General Bruce Fein, says, the "Professor never denies the Rajapaksa-Fonseka genocides," but, "delivers an indictment against the LTTE as a purported defense to the Rajapaksa-Fonseka genocides." Fein adds: "The genocide prosecution sought against Sudanese President Omar Bashir has rejected such a defense theory to a charge of genocide."

"I have prepared an approximately 400+ page model indictment against United States citizen and Sri Lankan Defense Minister Gotabhaya Rajapaksa and United States green card holder and Sri Lankan Lt. General Sarath Fonseka for genocide in violation of the Section 1091 of the United States criminal code. The United States law applies irrespective of the location of the genocide or the nationality of the genocide defendant. The model indictment is scheduled for publication and presentation to the United States Congress, the Department of Justice, and the Department of State in less than two weeks. The crime of genocide under United States law exposes the genocide defendant to the death penalty.

The model indictment elaborates a genocide narrative in the following manner. The politically and numerically dominant Sinhalese Buddhists have embraced and celebrated a culture of genocide against non-Sinhalese Buddhists since at least Sri Lankan independence in 1948. The genocide culture was informed by the Mahavamsa, the teachings of Dharmapala, and contemporary dogmas of Buddhist monks. Their common idiom is that Sri Lanka is an island for Sinhalese Buddhists only; and, that all others are intruders who must be either exterminated, expelled, or reduced to vassalage because of their ethnicity or religion. Thus, the Mahavamsa pays homage to King Duttugemenu for massacring Tamils who are described as sub-human.

The genocide indictment summons three types of evidence to establish guilt based on incidents since November 2005: approximately 3,000 incidents of extrajudicial murders or disappearances; approximately 1,000 incidents of causing serious bodily injury; and, approximately 2,000 incidents of creating conditions of life intended to cause the physical destruction of Tamils that affected 1 million, for example, starvation, deprivation of medicine, never-ending displacements that engendered permanent feelings of physical, economic, and psychological insecurity.

On December 15, 2008, Professor Rajiva Wijesinha, Secretary General, Secretariat for Coordinating the Peace Process, an echo chamber instrumentality of the Government of Sri Lanka, sallied forth on his website (www.peaceinsrilanka.org) with an awesome arsenal of irrelevancies and non sequiturs to confute my model genocide indictment. The Professor’s sophistry builds on the casuistry taught to every first year law student: If the law is against you, argue the facts; if the facts are against you, argue the law; and, if the law and the facts are against you, confuse the issue. Accordingly, Professor Wijesinha’s delivers an indictment against the LTTE as a purported defense to the Rajapaksa-Fonseka genocides. The genocide prosecution sought against Sudanese President Omar Bashir has rejected such a defense theory to a charge of genocide. In addressing the model genocide indictment I have prepared, this is what Professor Wijesinha adduces to persuade the reader to return a verdict of not guilty: not a single word or fact.

Indeed, the Professor never denies the Rajapaksa-Fonseka genocides. He simply bloviates: “Fein may see himself as an expert in pressing the right buttons, but [Tamils Against Genocide] should rethink squandering its funds on such characters.”

I challenge Professor Wijesinha or any official in the Government of Sri Lanka to debate me over the model genocide indictment at any time and in any venue of his or their choosing, including Colombo. I promise to arrive armed only with the truth; but my opponent may choose to come protected by the Sri Lankan Army and Pillaiyan. I am eager for a reply to my debate challenge. Silence will speak volumes of guilt.
